Murder In The Playground: Stunning New Evidence

Sources Tell CBS 2 HD Mallayev Caught In Web Of Lies

NEW YORK (CBS) ― The man police say gunned down a Queens orthodontist back in late October is back in New York awaiting trial. But before he got here CBS 2 HD went face to face with him.

You'll see the accused killer for the first time and hear exclusive details on how police are linking him to the crime.

Mikhail Mallayev is the man police say is the prime suspect in the murder of a Queens orthodontist, gunned down right in front of his estranged wife and 4-year-old daughter.

Only CBS 2 HD was there in Atlanta as NYPD detectives led Mallayev on board a flight back to New York City to stand trail for the murder of Daniel Malakov.

"I have nothing to tell you," Mallayev said at the time.

At the beginning of our journey back to New York Mallayev wasn't very talkative, but back when he was arrested he did plenty of talking to police. Mallavev gave detectives specific dates he had been in New York City around the time of the murder.

However, a stunning new twist has added serious doubt to his story.

CBS 2 HD has exclusively obtained a traffic ticket issued by the NYPD to Mallayev in Queens on the day he claimed he was in Georgia. Police identified Mallayev by his driver's license and cited him for not wearing his seatbelt. Police stopped him only a half-mile away from the Queens park where the murder happened six days later.

"I already told you I have nothing to say," Mallayev repeated en route to NYC.

Sources tell CBS 2 HD that Mallayev's own cell phone may end up doing the talking for him.

CBS 2 HD has learned that an hour before the brutal murder records show that Mallayev's cell phone was picked up by a cell tower. Sources say the signal or ping as it's called was traced right to the scene of the crime.

Back onboard the plane we wanted to know more about Mallayev's relationship with Mazeltov Borukhova, the victim's estranged wife. After police arrested him we learned the two were related by marriage.

Malakov and Borukhova had been embroiled in a nasty custody battle. The victim was granted full custody of 4-year-old Michelle just days before his murder.

The victim's family has accused Borukhova of hiring Mallayev to commit the murder.

All Mallayev would say about their relationship was that she was his niece and his doctor. He claimed the 65 cell phone calls between the two were all related to his health.

On the ground in New York Mallayev was taken off the plane first, and was greeted by more detectives and Port Authority police.

Although the trial date still isn't set, Mallayev is scheduled to be back in court for a hearing next week. If convicted he could face life in prison.
