The state's highest court is overturning one element of a lower court's $15 million judgment against Joel Steinberg, a man dubbed a "monster" in the New York tabloids following the death of his adopted 6-year-old daughter.
The state Court of Appeals is ordering a new trial to address an element of the award to the girl's birth mother. The 7-0 decision on Steinberg's appeal found that although there was evidence of prior abuse at the criminal trial, the issue wasn't "necessarily decided" in that trial.
Depending on the outcome, $5 million of the award could be altered.
Steinberg served 15 years in prison for killing his adopted daughter Lisa in 1987.
