Lawyer: Male Linked To Linda Stein Murder Scene

New Medical Examiner's Report Reveals Stunning Evidence

Manhattan DA's Office: Blood Speck Insignificant

NEW YORK (CBS) ― There were surprising new developments Tuesday in the case of murdered "Realtor to the Stars" Linda Stein.

Stein, 62, was killed last October inside her Fifth Avenue apartment.

Stein's 26-year-old personal assistant has been charged with the murder, but now a new report suggests someone else may have been involved.

Natavia Lowery has been in jail since being charged with Stein's brutal murder. Police say Lowery admitted she beat her employer to death with a piece of exercise equipment.

Lowery pleaded not guilty and her attorney, Ron Kuby, says a new report from the Medical Examiner's Office may help her defense.

"The medical examiner has shown us if not the identity the gender of the real killer of Linda Stein and it was a man," Kuby said.

The report shows that blood found in Stein's bathroom sink was Stein's mixed with an unidentified male. No blood from Lowery was found in the apartment.

"There had to be blood on the hands of killer and in the course of the attack he may have cut himself with the object he was using to bludgeon Linda to death," Kuby said.

Sources in the Manhattan district attorney's office tell CBS 2 HD the blood was a very small speck and there is nothing to indicate it came from the killer.

CBS 2 HD took the report to forensics professor Lawrence Kobilinsky at John Jay College.

He says the male DNA found will raise questions and prosecutors will need to prove the sample was there prior to the murder.

"The problem with DNA is that you cannot tell when the specimen was deposited, so in fact you can have two separate stains, each deposited at a different time, and if you collect them together, they will give you a mixture," Kobilinsky said.

CBS 2 HD asked the NYPD if this report prompted a new search for suspects. The agency referred us to the district attorney's office, which had no comment.

Lowery will be back in court on Wednesday afternoon.
