Republican state Sen. Martin Golden says a New York City councilman accused of slashing his girlfriend's face with a broken glass shouldn't be sworn into the Senate until his felony assault case is resolved.
Golden, of Brooklyn, introduced a resolution calling for Democratic Senator-elect Hiram Monserrate to delay filing his oath of office.
Monserrate has denied intentionally harming his girlfriend, Karla Giraldo, saying her injury was an accident.
State law gives Monserrate 30 days from the first of the year to file his oath. If he doesn't file, the seat would be declared vacant.
Senators convicted of felonies are automatically removed from office.
An official with the Senate Democrats says Republicans can't legally prevent Monserrate's oath.
