A New Rochelle police officer was arrested and charged with first-degree rape Wednesday morning, CBS 2 has learned.
Sgt. David Rodriguez was arraigned in New Rochelle City Court and suspended without pay by the department. The charge stems from an alleged incident on Feb. 9 while Rodriguez was off-duty.
Rodriguez pleaded not guilty to the charge. He would not comment to reporters.
Rodriguez is married to Darlene Rodriguez, an anchor for WNBC-TV. She walked into court aside her husband and was in tears outside the courtroom, but showed her support in a statement to reporters.
"I'm here to support my husband. I believe in him and I love him, and he's innocent 100 percent," she said.
Sources say the teen gave police an explicit description of an identifying characteristic on Rodriguez's lower body, and investigators found her "credible."
Rodriguez's attorney, Stephen Worth, said the allegations were false, however, and brought up in a "slip-shod fashion."
He added that "time will show the complainant here has a number of motives here to make a false allegation."
Last month, CBS 2 learned that the 17-year-old alleged victim claimed four officers went to her house on Feb. 8 and arrested her live-in boyfriend after responding to a domestic violence call. Police said the alleged victim claims Rodriguez came back to her home when his shift ended and forced her to have sex.
Rodriguez' northern Westchester home was searched for evidence and the officer was suspended afterward, but Commissioner Patrick Carroll had asked for the public to hold off on prosecuting the nine-year veteran, who he said, "has a sterling record."
City Judge Preston Scher set bail at $25,000. If convicted, Rodriguez faces up to 25 years behind bars.
He's due back in court again on April 17.
