Court Rejects NJSPCA Lawsuit Against Testing Lab

Suit Alleges Abuse

NEWARK, N.J. (AP) ― An appeals court has tossed the remainder of a lawsuit against a laboratory in Somerset County that tests products on animals.

The New Jersey Society for the Prevention of Cruelty to Animals accused Huntingdon Life Sciences of negligence based on videotapes from undercover activists.

The group said the lab caused unnecessary pain and suffering to animals.

The appeals court says there is no basis for restitution, because the NJSPCA did not lose money when Huntingdon profited. It also says injunctions would not be appropriate for acts that happened about a decade earlier.

A trial judge presviously said the organization had no reason to sue and Huntingdon had no obligations to the NJSPCA.
