The dentist wants to cut a deal, but the District Attorney is saying "no dice."
So it looks like Dr. William Moody will be going to trial on a misdemeanor assault charge, stemming from his "parking rage" incident captured on video by a CBS 2 crew.
Friday, Moody made a brief appearance before White Plains city judge Barbara Leak. His attorney, Gary Jenkins, told the judge "we have gone through long and substantive negotiations, but the District Attorney insists that Dr. Moody plead guilty as charged."
"And so reluctantly, we must go to trial," said Jenkins.
Last November, the CBS 2 Westchester crew videotaped Dr. Moody during an angry and violent confrontation with a man and his sister. The man, Luis Infante, was in a car that was blocking Moody's access to a driveway.
The tape, viewed by millions on the internet, showed Moody pushing Infante away and climbing into Infante's car to move it himself.
When Infante objected, Moody got out of the car, shoved Infante, then walked away.
Moody then walked over to CBS 2 photographer Chris Calarco and grabbed the lens of Calarco's camera.
Then Moody confronted Luis Infante's sister, Yolanda. As Moody charged at her, she put her arms up and briefly touched Moody's chest. At point, the dentist became enraged, and shoved Yolanda Infante to the ground.
Court documents show Moody has a long record of being charged with harrassment or assault, pleading the charge down to a violation, and walking free.
This time, the office of District Attorney Janet DiFiore has refused to offer a plea deal, and Moody has refused to plead guilty as charged. So the case has been set for trial on June 2.
Moody also faces charges from a confrontation earlier on the same day. White Plains police say he rear-ended another driver, then took the driver's registration papers and drove away.
He's also charged with contempt of court for allegedly violating an order to avoid all communication with Yolanda Infante.
