NYC Sued For $2 Mil Over School Sex Assault
Father Claims 7-Year-Old Daughter Was Repeatedly Attacked At P.S. 106 In Queens And School Did Nothing

FAR ROCKAWAY, N.Y. (CBS) ―
A pastor from Queens says his daughter was repeatedly tormented and sexually assaulted in the second grade by classmates, and the school did nothing to protect her.
CBS 2 HD tried to get to the bottom of this disturbing story.
Andres Oyola-Rodriguez broke down as he talked about his daughter being sexually assaulted in the school library by a classmate, when she was 7 years old.
"You know how my daughter feels? And my family what we went through in that school? You have no idea, what she went through in that school and me and my family, calling the chancellor, the regional office, everything," Oyola-Rodriguez said.
"You had a parent who had a serious sexual assault not once but twice," attorney Adam Thompson added. "He goes to the school to report this no one from the school does anything!?"
Oyola-Rodriguez said it happened as P.S. 106 in far rockaway, starting as bullying in 2005 and progressed to sexual assault by 2007. He said the principal wouldn't meet with him, and he got no action from the chancellor's office, so he filed a police report. The NYPD said the case is still open.
Christina Rodriguez said she's not surprised at the allegations. She's now trying to get her 6-year-old son transferred out of P.S. 106, after he started getting bullied at the school three months ago.
"This is real serious," Rodriguez said. "I called the Board of Ed. I called 311."
She said no one will even investigate, and teachers have told her they have to see the abuse to do anything.
Her son told CBS 2 HD he's afraid to go to school.
"It's not fair and I don't like it!" the first-grader said.
Oyola-Rodriguez is now suing New York City and the Board of Education for $2 million. His daughter is now 9 years old, and while she's in another school, he said she's not the same.
The school principal would not speak with CBS 2 HD and the Department of Education said it won't comment on the case, pending litigation.
