The judge in the John A. "Junior" Gotti racketeering case declared a mistrial Tuesday on the most serious charges after the jury came back deadlocked.
The jury found Gotti not guilty of a lesser count of conspiracy to commit securities fraud. That verdict will stand.
U.S. District Judge Shira Scheindlin declared a mistrial on the remaining counts and discharged the jury after it indicated that it was unable to reach a decision about the bulk of the case.
The partial verdict came on the eighth day of deliberations in Gotti's trial. The charges included an allegation that he plotted the kidnapping of Curtis Sliwa, the founder of the Guardian Angels crime-fighting group.
Prosecutors told the judge that they would seek to retry Gotti, the son of the late mob boss John Gotti.
Defense attorneys asked that Gotti be released on bail. Scheindlin said she was likely to grant the request, drawing applause from his supporters.
