Accused Hitman Sits Down For Jailhouse Interview

Mikhail Mallayev Charged In The Murder Of Queens Dentist

NEW YORK (CBS) ― Mikhail Mallayev is on Rikers Island. He's awaiting trial for the murder of Queens orthodontist Daniel Malakov.

Talking for the first time since prosecutors charged him with first degree murder, Mallayev said he is innocent.

"I didn't do this," Mallayev said. "I'm the husband over 30 years. I'm the father and I'm the grandfather and I'm far away from any of that kind of thing."

Police say Mallayev gunned down the Queens orthodontist in front of his estranged wife and 4-year-old daughter in a park last October.

When asked straight out if he killed Malakov, Mallayev said, "Of course not, never."

But prosecutors say the evidence against him is overwhelming. Police found Mallayev's fingerprints on a homemade silencer left at the scene of the crime.

"The detectives told me they have partial fingerprints," Mallayev said.

But police say the prints are a match – and that's not all.

After his arrest investigators learned Mallayev was actually related to the victim's estranged wife, Dr. Mazeltov Borukova.

At the time of the murder Borukova and her husband were in a nasty custody battle police believe Borukova hired Mallayev to get rid of him.

"I didn't do this and I never gonna be involved to helping somebody to kill somebody," Mallayev said.

But phone records show nearly 100 calls between the two in the days leading up to the murder. Mallayev claims Borukova was his doctor.

"All those calls were just for the treating of medical stuff," Mallayev said.

Mallayev says he's a deeply religious and spiritual man, not a cold-blooded killer.

"The first commandment says do not kill," he said. "If you kill somebody you go straight to hell. That's it. No excuses."

But prosecutors say Mallayev is nothing more than a hired hitman, paid nearly $20,000 to pull the trigger.

As he sits on Rikers Island awaiting trial he insists he didn't do it.

"The real killer out there and he's laughing on all of us," Mallayev said.

Mallayev is charged with first degree murder and conspiracy to commit murder. If convicted he will face life in prison without the possibility of parole.
