Two Suspects Appear In Criminal Court In The Bronx

BRONX (CBS) ― A teenager charged with murder, 18-year-old Jose Calderon, was brought before a judge Friday after he declined his right to appear before a grand jury. Also appearing in criminal court in the Bronx was Aleshia Smith, 26, the mother of 4-year-old Quachaun Brown, whom police say was beaten to death last weekend.

The incident happened in Smith's apartment on Kossuth Avenue in the Bronx. Police say Calderon held the boy by the ankles and slammed his face against a wall, because he thought the child had knocked over a 26-inch TV.

Police sources say the child's mother ignored the child's injuries for two days, even taking him to a Chuck-E-Cheese restaurant where he vomited blood. The child was found dead in his mother's apartment Monday morning.

Smith is charged with manslaughter, but her attorney says she was also a victim of Calderon's violence.

"She attempted to get medical assistance, and was told she would not be able to do so by him. She was segregated in the apartment," Lewis Mazzone said.

Investigators say Calderon confessed to beating the child last Friday and Saturday, but Calderon's attorney would not confirm it.

"He plead not guilty. That's our position. He's not guilty," Edward Zizmore said.

Police believe the boy died Sunday night and said Smith woke up early Monday to find Calderon trying to revive her son.

Teachers repeatedly warned that Quachaun's sisters came to school hungry and dirty, if they showed up at all. The question is not only what role did the two defendants play, but should city agencies have spotted problems before the child's death.
