NY Jury Signals Possible Deadlock In Gotti Case

Jury heads back to work on Tuesday morning

NEW YORK (CBS) ― The jury in the John "Junior" Gotti trial goes back to work this morning under orders from the judge. This comes after jurors sent out a note yesterday, saying they're deadlocked after seven days of deliberations.

He is called the prince of the Gambino crime family. But when, if ever, did John Junior Gotti quit the mob? This is the issue that appears to have the jury deadlocked. The judge has sent them back to work as deliberations begin this morning.

Gotti's lawyer has argued all along that Junior "resigned" from the family business of heading the Gambino crime family after pleading guilty to federal racketeering charges in 1999. But prosecutors contend the 41-year-old son of the dapper don continued to run his father's mob empire in 2001 and 2002.

Junior is also charged with directing two mob thugs to kidnap and assault radio talk show host Curtis Sliwa after he made disparaging remarks about his father.

But since yesterday's note reveals that the jury can't decide when Gotti hung up his gangster hat, the whole case could fall apart and a mistrial could be declared.

Outside the courtroom yesterday, Peter Gotti, Junior's brother told CBS 2's Pablo Guzman that if a tape recording his brother made had been admitted in court things would be very different right now.

Meanwhile, Peter Gotti also says that whole case depends on the testimony of low-lifes, which isn't surprising since it is a mob trial. If convicted, John Junior Gotti faces up to 30 years in prison.
