Lawyer: Woman Slammed By Yonkers Cop Was Drunk

Officer Simoes' takedown of Irma Marquez on March 3 amounted to assault and violated her right against unreasonable force from a police officer, a federal grand jury said.

A government lawyer says a woman was drunk and interfering with police when an officer body-slammed her and knocked her unconscious.
Yonkers city lawyer Peter Meisels made the claim in court Friday. But the woman's lawyer, Gary Certain, said two other officers have testified she wasn't getting in their way.
Yonkers Officer Wayne Simoes hurled Irma Marquez face-first onto a tile floor at a restaurant in March 2007. The incident was captured on surveillance tape. Marquez says she was attacked while trying to tend to her niece, who had been hit by a bottle.
Marquez was acquitted of obstructing police. She's suing the Yonkers police force for $11 million.
Simoes has pleaded not guilty to a federal civil rights charge.
