An Oswego County judge is set to hear a defense lawyer's arguments for setting aside the conviction of a 29-year-old central New York man on charges he murdered his 11-year-old stepsister.
Alan Jones of Palermo was found guilty in September of killing Erin Maxwell, who lived in filth and was starved by her parents. He faces a maximum of 25 years to life in state prison and could be sentenced Monday morning if the conviction is upheld.
Jones' defense attorney had argued during the trial that Erin accidentally hanged herself while acting out a scene from the "Pirates of the Caribbean" movies in her bedroom on Aug. 29, 2008. Prosecutors said Jones strangled the girl.
Maxwell's parents were each sentenced to two years in jail for child endangerment.
