Firefighter Injured Near Deutsche Bank Files Suit

NEW YORK (AP) ― A firefighter hurt in a construction accident five days after a fatal fire at a ground zero tower has sued the state owner of the building and its contractors.

Neil Nally, one of two firefighters injured when a pallet jack fell more than 20 stories and smashed a construction shed outside the former Deutsche Bank tower, sued the Lower Manhattan Development Corp., the state agency that owns the building, and contractors Bovis Lend Lease and John Galt Corp.

Galt was fired after the Aug. 23 accident, which happened when contractors were cleaning debris from the blaze that killed two firefighters. Officials said a Galt worker lost control of the jack, which fell off an elevator and crashed through the shed where firefighters Nally and William Corbetis were on patrol securing the building.

Nally suffered permanent injuries and remains off the job because of the "negligence, carelessness and recklessness" of the building's owners and contractors, according to the lawsuit filed Tuesday in Manhattan's state Supreme Court.

An LMDC spokesman didn't immediately comment Wednesday.

Representatives of Bovis and Galt declined comment Wednesday.

The 26-story partially dismantled tower was damaged when part of the World Trade Center collapsed into it on Sept. 11, 2001. Prosecutors have called a grand jury to pursue possible criminal charges stemming from the Aug. 18 blaze.
