Examiner: Nixzmary Gained Only 1 Pound In 2 Years

  A medical examiner says 7-year-old Nixzmary Brown was so malnourished by the time she was beaten to death that she had gained only 1 pound in the previous two and a half years.

Deputy Medical Examiner Dr. Barbara Sampson testified Friday that there was no food in the 36-pound Brooklyn girl's stomach when she suffered a fatal blow to the head on Jan. 11, 2006.

Nixzmary's stepfather, Cesar Rodriguez, is on trial on a murder charge. He has pleaded not guilty, and his lawyer has portrayed Nixzmary's mother as the killer and the girl as a troublemaker. The mother faces a separate murder trial.

Rodriguez' lawyer, Jeffrey Schwartz, suggested Friday that Nixzmary's low weight might have reflected an illness. Prosecutor Ama Dwimoh noted the girl's empty stomach.
