The mother of 7-year-old Nixzmary Brown may be called to testify as a witness in the Brooklyn trial of her husband, who is accused of killing the girl.
The attorney for Cesar Rodriguez said he intends to call Nixzaliz Santiago as his first witness.
Whether that happens remains to be seen, given Santiago's right
to refuse to incriminate herself.
Rodriguez' attorney, Jeffrey Schwartz, has been attempting to show to jurors that while his client may have beaten the girl to discipline her, he did not deliver the blow that took her life.
Rodriguez has pleaded not guilty to charges he killed Nixzmary on Jan. 11, 2006, while punishing her for stealing yogurt. Santiago faces a separate murder trial.
